The petitioner has been arrested in connection with Sessions Trial No. 447 of 2009 arising out of Surajgadha (Kajra) P.S. Case No. 353 of 2008 registered under Sections 364, 302 and 34 of the Indian Penal Code.
Earlier bail petition of the petitioner was rejected. Perused the report. It has been reported that step has been taken for evidence of witnesses of I.O. and Doctor only and it has been reported that case may be disposed of within three months. Learned counsel for the petitioner submits that petitioner is in jail custody since 22.12.2008.
Hence the trial court is directed to take coercive step against the witnesses through the concerned Superintendent of Police, Lakhisarai for production of witnesses.
The Superintendent of Police, Lakhisarai, is directed to take steps for attendance of the witnesses on the date fixed so that trial may be concluded within three months.
With this observation, the bail petition is disposed of. m.p.
