The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 387 and 120B of the Indian Penal Code.

As per prosecution case, the informant alleged that the petitioner along with other co-accused person demanded rangdari (extortion) on mobile phone from the teachers and other businessmen of Haweli Kharagpur. The accused persons also threatened them, if extortion has not been paid, they will killed them.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. It is further submitted vide para 7 of the petition that the mobile numbers mentioned in the FIR of the present case are not purchased on

No.34272 of 2022(5) dt.14-02-2023 2/2 the basis of identity proof of the petitioner but merely on suspicion, the petitioner has falsely been implicated in this case saying that these mobile phones belong to the petitioner. The alleged call details record has also not been submitted before the concerned Court. No TI Parade was made in any of the case lodged against the petitioner till date and nothing incriminating article has been recovered from his conscious possession. Moreover, the petitioner is languishing in judicial custody since 23.2.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kharagpur P.S. Case No. 54 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Munger.
