On the last date the matter was adjourned giving an opportunity to learned counsel for the petitioner to file a rejoinder to the counter affidavit filed on behalf of the respondent nos. 3 and 4 who have in their second supplementary counter affidavit categorically stated that all the mentioned claims of the petitioner stand settled and paid. Patna High Court CWJC No.16160 of 2018(5) dt.18-06-2020 2/3 also given to learned counsel for the State to seek instruction from the Treasury Officer, Darbhanga as to whether the payments on account of difference of salary and leave encashment have been made or not.
Today, it has been informed by learned counsel for the State that he has instruction to say that the Treasury Officer, Darbhanga has made all the payments on the above heads. Learned counsel for the petitioner submits that there being categorical statement regarding the payments, this writ application may be disposed of with liberty to the petitioner to raise his grievance, if any, with respect to calculation etc. if so arises in connection with the payments made to the petitioner. In the aforesaid view of the matter, this writ application is being disposed of in the light of the statements made in the counter affidavits and supplementary counter affidavit filed on behalf of respondent nos. 3 and 4 living it open for the petitioner to raise his grievance, if any, with respect to calculation and quantum of the amount so paid to him. If such a grievance is raised within a period of 30 days from today before the Registrar, L.N.M.U., Darbhanga (respondent no. 4), the same shall be considered and disposed of by respondent no. 4 within a period of 90 days from the date of receipt of such
