The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 342, 336, 308 and 379/34 of the Indian Penal Code. The prosecution case is that the petitioner made assault with brick to the informant on his head for protesting against the consumption of liquor in public place. It is submitted by learned counsel for the petitioner that the informant has not received any injury. Statement to that effect has been made in paragraph 8 of the petition, which reads as follows:- "That no injury has been received by the informant due to assault by the petitioner to the

A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail provisionally for three months, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Patna City, Patna in connection with Sultanganj P.S. Case No. 226 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

The provisional bail of the petitioner will be confirmed by the learned court below, if it is found that the informant has not received any grievous injury. (Dinesh Kumar Singh, J) DKS/- U T
