JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-07-2015 Heard learned counsel for petitioner and learned Additional Public Prosecutor for the State. The name of petitioner came in confessional statement of c-accused, Ashok Kumar as well as in the statement of witnesses, namely, Dudheshwar Prasad and Teja Sah. The statement of Dudheshwar Prasad was recorded at paragraph-9 of the case diary and this witness stated only to this effect that one person was talking on mobile phone, disclosing the name of this petitioner and so far as statement of witness, Teja Singh is concerned; it would appear from perusal of paragraph-16 of the case diary that he claimed to have seen the petitioner along with Munna Kumar and co-accused, Ashok Kumar, prior to the
Patna High Court Cr.Misc. No.49779 of 2014 (4) dt.29-07-2015 2/2 alleged occurrence and except the aforesaid materials, there appears to be nothing against him.
No doubt, petitioner carries criminal antecedent of several cases but he is in jail custody since 24-09-2013 and some co-accused including Munna Kumar have already been admitted to privilege of bail by different benches of this court.
Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Udwantnagar P.S. Case No. 165 of 2013 to the satisfaction of Learned Chief Judicial Magistrate, Ara.
