The petitioner seeks bail in Chapra Town P.S. Case No. 05 of 2014 dated 03.01.2014 instituted under Sections 379/411 of the Indian Penal Code.
This is the second attempt of the petitioner for bail as earlier the prayer for bail in Cr. Misc. No. 9784 of 2014 was rejected by order dated 19.04.2014.
The petitioner is alleged to have been caught along with a stolen motorcycle.
Learned counsel for the petitioner submits that he has no criminal antecedent and that he had gone to the Bank and unfortunately was present near the motorcycle when the police is allegedly to have caught hold of him on 03.01.2014.
Learned A.P.P. opposes the prayer for bail.
Patna High Court Cr.Misc. No.41703 of 2014 (2) dt.11-05-2015 2/2 Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in Chapra Town P.S. Case No. 05 of 2014. One of the bailors shall be the father of the petitioner. The petitioner and the bailors shall execute bond with regard to good behaviour of the petitioner. The petitioner shall also give an undertaking to the Court that he shall not indulge in any criminal activity. Any violation of the terms and conditions of the bonds or the undertaking shall lead to cancellation of his bail bonds. The petitioner shall cooperate in the trial and be present before the Court on each and every date. Failure to cooperate or appear on two consecutive dates, without sufficient cause, shall also lead to cancellation of his bail bonds.
