The petitioner is languishing in jail since 22.09.2014 in a case registered for the offences punishable under sections147, 148, 149, 341, 325, 324, 307, 447,504 of the Indian Penal Code and later on section 302 I.P.C was also added. It is alleged that during altercation between mother of Jitendra Mahto and daughter of Panchu Mahto the informant tried to pacify the matter when all the nine F.I.R. named accused assaulted Gokhul Mahto the husband of the informant who succumbed to the injury.
It is submitted by the learned counsel for the petitioner that There is omnibus general accusation of assault
Patna High Court Cr.Misc. No.1015 of 2015 (2) dt.12-01-2015 against nineF.I.R. named accused persons and the petitioner's name has surfaced during the investigation though charge sheet has been submitted against the petitioner also but the postmortem report does not reveal any external injury though subdural haematoma was found on both side of the brain. Considering the fact that the specific accusation is against all the accused persons name in the F.I.R and petitioner was named in the F.I.R. let the above named petitioner be released on bail on furnishing bail bond of Rs. 10000/- (ten thousand) with two sureties of like amount each to the satisfaction of Shri Deepak Kumar, learned J.M. Ist Class, Sitamarhi in connection with Bela P.S. Case No. 166 of 2014. (Dinesh Kumar Singh, J) M.Rahman/- U T
