The petitioner seeks bail in anticipation of his arrest in connection with Amnour P. S. Case No. 27 of 2020, dated 03.02.2020, instituted for the offences under Sections 420, 468, 379 and 414 of the Indian Penal Code.

One person, namely, Rajnikant Kumar was found by the Cashier of making attempt for withdrawing money from the Bank in an unauthorized manner. On an earlier occasion he had withdrawn Rs. 40,000/-. On the

Patna High Court CR. MISC. No.33056 of 2020(2) dt.09-03-2021 2/3 day when aforesaid Rajnikant Kumar was caught, he was standing in a queue with a requisition for Rs. 25,000/- but he was spotted, identified and arrested.

The implication of the petitioner is only on the confession of the aforesaid Rajnikant Kumar, from whose possession Rs. 40,000/- has been recovered. Aforesaid Rajnikant Kumar has stated that the petitioner happens to be his friend who always participates in his illegal acts.

The learned counsel for the petitioner has submitted that except for this confession by an arrested accused person, there is no other material to connect the petitioner with the offence.

The petitioner does not have criminal antecedents.

Considering the afore-stated two facts, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date

No.33056 of 2020(2) dt.09-03-2021 3/3 of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. - 2, Saran at Chapra, in connection with Amnour P. S. Case No. 27 of 2020, subject to the conditions as laid down under Section 438 (2) Cr.P.C.

The application stands allowed.
