The petitioner seeks bail in connection with Alamnagar P.S. Case No. 166 of 2015 registered for the offences punishable under Sections 385, 386/34 of the Indian Penal Code. Allegedly, the petitioner and co-accused Kunal Singh came at the shop of the informant, started abusing him and demanded ransom of Rs. 2,00,000/- on the plea that due to his deposition in the case of Pappu Jaiswal they have suffered loss of Rs. 2,00,000/-and further assaulted the informant with butt of three nut and snatched gold chain and cash of Rs. 21,000/- from cash box.

Submission is of false implication and that due to business rivalry the informant and his relatives have earlier implicated the petitioner in six cases and in all cases the petitioner

Patna High Court Cr.Misc. No.5758 of 2016 (2) dt.17-02-2016 is on bail, the informant is harassing the petitioner by filing one case after another and as such the petitioner who is suffering in custody since 19.11.2015 deserves sympathetic consideration as allegation under Section 379 IPC is ornamental one. Learned A.P.P. duly assisted by learned counsel for the informant opposes the prayer of bail by pointing out that the petitioner has got criminal antecedent.

In the facts and circumstances stated above, considering the detention of the petitioner now he is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned S.D.J.M., Uda, Kishunganj, Madhepura, in connection with Alamnagar P.S. Case No. 1666 of 2015 subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
