JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 14.06.2014 in a case registered for the offences punishable under Sections 302, 120B/34 of the Indian Penal Code and 27 of the Arms Act. Although, petitioner is named in the first information report but according to prosecution case itself, it was co-accused, Jatindar Sah who committed the murder of the deceased. So far as petitioner is concerned, co-accused, Jatindar Sah confessed his guilt disclosing this fact that this petitioner insisted upon him to eliminate the deceased.
Considering the aforesaid facts and circumstances as
Patna High Court Cr.Misc. No.2698 of 2015 (2) dt.21-01-2015 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Bettiah, West Champaran in connection with Yogapatti (Nawalpur) P.S.
