JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 14.06.2014 in a case registered for the offences punishable under Sections 302, 120B/34 of the Indian Penal Code and 27 of the Arms Act. Although, petitioner is named in the first information report but according to prosecution case itself, it was co-accused, Jatindar Sah who committed the murder of the deceased. So far as petitioner is concerned, co-accused, Jatindar Sah confessed his guilt disclosing this fact that this petitioner insisted upon him to eliminate the deceased.

Considering the aforesaid facts and circumstances as

No.2698 of 2015 (2) dt.21-01-2015 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Bettiah, West Champaran in connection with Yogapatti (Nawalpur) P.S.
