02-11-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Siwan Muffasil (Mahadeva O.P.) P.S. Case No. 518 of 2020, registered for the offence under Sections 323, 324, 341, 382, 411/34 of the Indian Penal Code.

As per the prosecution case, on 19.11.2020 at about 6:00 AM, when the informant and his friends were going to coaching centre and reached near Malviya Chowk, four miscreants came there and snatched their mobile phones and assaulted them and thereafter, tried to flee away, however; on chase, this petitioner was caught by local people. It is submitted on behalf of petitioner that no stolen article has been recovered from the possession of the petitioner. In fact, the petitioner was returning from market after purchasing some house-hold articles and some persons caught him on suspicion and handed over to police. Petitioner is in

Patna High Court CR. MISC. No.44054 of 2021(3) dt.02-11-2021 2/2 custody since 20.11.2020. Chargesheet has been submitted. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Siwan Muffasil (Mahadeva O.P.) P.S. Case No. 518 of 2020.
