The petitioner has preferred this application for grant of regular bail in connection with Pipra Kothi P.S Case No 213 of 2022 dated 18.07.2022 registered for the offences punishable

Patna High Court CR. MISC. No.34797 of 2023(2) dt.25-05-2023 2/3 under section 272, 273, 308, 414 read with section 34 of the Indian Penal Code and Section 25(1-B)a/26 of Arms Act and sections 30 (a), 32, 41 (1) of the Bihar Prohibition and Excise Act.

As per the prosecution case, 25 liters of country made liquor and a country made pistol were recovered near the vegetable field. The name of the petitioner was identified by the local people.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is accused in 5 other criminal cases as stated in para 3 of the bail petition. The petitioner is in custody since 16.01.2023.

Learned A.P.P for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court no.-1 Civil Court, East Champaran at

(1) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner is liable to be cancelled. The application stands allowed.
