The petitioner seeks bail in Awtar Nagar P.S. Case No.93 of 2010 instituted for the offences under Sections 147, 148, 149, 342, 323, 326, 307, 379, 302 and 504 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation has been made against the petitioner that he fired from his country made pistol which hit the victim and other accused persons have also assaulted the victim with different lethal weapons.
Learned counsel for the petitioner submits that out of ten witnesses altogether nine witnesses have been examined. In such view of the matter, this Court is not inclined to
Patna High Court Cr.Misc. No.3050 of 2015 (3) dt.04-03-2015 enlarge the petitioner on bail. Accordingly the prayer for bail is rejected. However, trial court is directed to conclude the trial within a period of six months from the date of receipt/ production of a copy of this order.
