2. The petitioner apprehends arrest in connection with Marhowrah PS Case No. 609 of 2020 dated 08.07.2020, instituted under Sections 30 and 30(a) of the Bihar Prohibition and Excise Act, 2016.

3. The allegation against the petitioner is that from the place where the police effected recovery of 135 litres of raw spirit, the petitioner and other two co-accused fled away after seeing the police.

4. Learned counsel for the petitioner submitted that he has not been arrested and there is no recovery from his possession or from his house. It was submitted that the

5. Having perused the records, it transpires that the petitioner is accused in two other cases of the year 2017, under Sections 188, 272, 273, 308 of the Indian Penal Code as also the Excise Act.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, the Court is not inclined to grant pre-arrest bail to the petitioner.
