2. The petitioner seeks bail in connection with Athmalgola P.S. Case No. 77 of 2023 dated 24.03.2023, instituted for the offence punishable under Sections 414, 34 of the Indian Penal Code.
3. The Prosecution case, in short, is that the petitioner along with co-accused is alleged to steal two buffaloes and was caught by villagers while taking it away on their Pickup van.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that the petitioner is not the driver of the Magic van bearing Registration No. BR01GD-4729. The alleged van belongs to Vinay Saw. Lastly, it has been submitted
Patna High Court CR. MISC. No.34598 of 2023(2) dt.24-06-2023 2/2 that the petitioner is in custody since 25.03.2023 having no criminal antecedents and charge-sheet has been submitted in the case.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Barh, Patna in connection with Athmalgola P.S.
