JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-05-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 26.03.2011 on the accusation that he was caught red handed while assembled to make preparation for committing dacoity and on being searched, one loaded pistol and one loaded katta were recovered from his conscious possession.

The trial court has reported that charge against the petitioner could not be framed due to non-cooperation of other accused.

Considering the aforesaid facts and circumstances as well as period of detention of the petitioner in jail custody, let the
