JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-09-2018 The present writ petition has been filed for quashing the order dated 25.06.2018 issued by the District Certificate Officer, Buxar.

The learned counsel for the petitioners submits that

Patna High Court CWJC No.14878 of 2018 (3) dt.17-09-2018 2/2 the petitioners have already filed a petition under Section 9 of the Bihar and Orissa Public Demand Recovery Act, 1914, however, the Certificate Officer is proceeding in the matter without adjudicating the case after considering the objection filed by the petitioner.

In view of the aforesaid, the present writ petition is disposed of with a direction to the Certificate Officer to consider the objections filed by the petitioners and pass a final order after hearing them. In the meantime, i.e. till the passing of the final order, no coercive action shall be taken against the petitioners. With the aforesaid direction, the present writ petition is disposed of.
