Petitioner apprehends arrest in a case registered for the offence punishable under Sections 8(c), 20(b)(ii)(c), 22(c), 23(c), 25 and 29 of Narcotic Drugs and Psychotropic Substances Act,1985.

As per prosecution case, 108.6 kilograms of Ganga was recovered from the house of co-accused Awinash Kumar @ Vicky and this petitioner along with other co-accused persons is alleged to have fled away from the place of occurrence. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner and he has been made accused in this case only on the basis of confessional statement

Patna High Court CR. MISC. No.34197 of 2022(4) dt.17-11-2022 2/2 of co-accused Arzu Rain who was apprehended on the spot. Petitioner has got clean antecedent.

Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Learned Sessions Judge-cum-Special Judge, Sitamarhi in Sursand P.
