The petitioner seeks bail in Sahodara P.S. Case No. 01 of 2019, instituted for the offence under Section(s) 302 and 34 of Indian Penal Code.

Counsel for the petitioner submits that co-accused Ranjeet Kumar has already been granted bail by this Court vide order dated 1.7.2019 passed in Cr. Misc. 32413 of 2019. It is alleged in the written report that daughter of informant was married with Jagdish Sah. She was blessed with four children. The informant got information from her matrimonial house that his daughter was traceless. The informant came to Sasural of his daughter and started making search. During course of search some villagers disclosed that dead body of woman was lying in a sugarcane field. The informant went to the field and identified the dead body.

Patna High Court CR. MISC. No.31285 of 2019(4) dt.12-07-2019 2/2 During course of investigation, Jitendra Kumar of his village was arrested by the Police who disclosed the name of petitioner in his confessional statement. The Police also recorded confessional statement of the petitioner.

Counsel for the petitioner submits that petitioner has no nexus with the aforesaid occurrence. He has been implicated in the instant case only on the basis of confessional statement recorded by the Police.

Petitioner is in custody since 1.1.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, West Champaran at Bettiah, in connection with Sahodara P.S. Case No. 01 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
