The petitioner seeks bail in Minapur P.S. Case No.183 of 2019 registered under Section 394 of the Indian Penal Code. The informant alleged that while he was returning to his village, three miscreants came on a motorcycle assaulted the informant with knife on his hand and thereafter snatched his vehicle.

The learned counsel for the petitioner submits that petitioner is not named in the F.I.R. Name of the petitioner surfaced in the case in the confessional statement of co-accused. Save and except the confession, there is no other material to show the involvement of the petitioner. Petitioner is in jail since 22.05.2019. It is submitted that petitioner has not been put on T.I.P. Petitioner was not having any criminal antecedent on the

No.32364 of 2020(2) dt.07-12-2020 2/2 date of arrest of the petitioner and when the petitioner was arrested in this case, on the basis of the confessional statement of co-accused, petitioner is made accused in many other cases. Taking into consideration the facts aforesaid and the fact that the petitioner is in jail for more than 11⁄2 years on the basis of the confessional statement of co-accused, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Mr. Aftab Alam, learned J.M. 1st Class, Muzaffarpur in connection with Minapur P.S. Case No.183 of 2019.
