The petitioner seeks bail in anticipation of his arrest in connection with Sandesh P.S. Case No. 253 of 2019, dated 10.11.2019, instituted for the offences under Sections 341, 323, 325, 307, 504 and 506/34 of the Indian Penal Code.

Patna High Court CR. MISC. No.32619 of 2020(2) dt.20-02-2021 2/3 A scuffle took place between the brother of the informant and one Amarjeet Nut over consumption of liquor. The informant tried to intervene in the matter, but he too was attempted to be assaulted. In that process, it is alleged that the petitioner and another came to the place of occurrence with lathi in their hands. Later, when the wife of the informant came to the rescue, she was assaulted on her head by Amarjeet Nut, leading to injuries on her person. Learned counsel for the petitioner has submitted that though he has been named in the F.I.R., but there is no specific accusation against him of either assaulting the informant or his wife.

The accused person who had assaulted the wife of the informant and had caused grievous injuries was arrested and, thereafter, has been granted bail. Regard being had to the facts afore-stated and taking into account that the petitioner does not have criminal antecedents, he, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail bonds in the sum of Rs.
