NATH ORAL ORDER 04-03-2015 Heard the learned counsel for the petitioner. Nobody appears on behalf of the State to oppose the prayer for bail of the petitioner.

The petitioner seeks regular bail in connection with Agiaon (G) P.S. Case No. 62 of 2014 for the offences punishable under Sections 420, 406, 302, 201/34 of the Indian Penal Code.

The learned counsel for the petitioner has submitted that it is the only material against the petitioner that he was last seen with the deceased Ganesh Yadav. It has been further submitted that the petitioner has been implicated only on the basis of suspicion.

However, after considering the facts and

No.2152 of 2015 (3) dt.04-03-2015 circumstances as well as submissions, it is apparent that during the course of investigation the materials have come to corroborate that the petitioner played the active role in the murder of the deceased Ganesh Yadav. This Court therefore is not inclined to enlarge the petitioner on bail.

The prayer for bail of the petitioner is, accordingly, rejected.
