The petitioner is apprehending his arrest in connection with Bikramganj P.S.Case No.502 of 2018 , registered for offences punishable under Sections 366(A)/34 of the Indian Penal Code.
Prosecution story is of kidnapping of the minor daughter of the informant by the petitioner and other accused persons. Submission of the learned counsel for the petitioner is that in her statement recorded under Section 164 Cr.P.C. she has disclosed her age as 19 years and the learned court below has assessed her age as 15 years, however, she has named the co-accused person that she was in talking term with Santosh
Patna High Court CR. MISC. No.32422 of 2019(2) dt.16-05-2019 2/2 Kumar and the petitioner happens to be father of Santosh Kumar.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Bikramganj, Rohtas at Sasaram in connection with Bikramganj P.S.case No.502 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. With the aforesaid direction, this application is allowed.
