1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Buxar GRPS (Railway Patna Buxar FIR) Case no. 154 of 2024 registered under sections 317(5) and 3(5) of Bharatiya Nyay Sanhita, 2023.

3. As per the prosecution case, seeing the police personnel, it is stated that the movement of the accused persons became suspicious. On being confronted and search being conducted a mobile phone was recovered from his possession which he confessed to have stolen from a passenger.

4. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from his possession. He is in custody since 12.9.2024 and chargesheet

5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R., his being in custody for 9 months since 12.9.2024 and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Buxar GRPS (Railway Patna Buxar FIR) Case no. 154 of 2024 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Railway, Bhojpur at Ara.
