The petitioner is in jail custody since 17-07-2014 in a case reregistered under Section-302 and other minor sections of the Indian Penal Code and 27 of the Arms Act as well as Section3(I)(X) of the SC./ST (Prevention of Atrocities) Act. It has, specifically, been mentioned in the first information report that the deceased died due to fire-arm injury and the postmortem report of the deceased also corroborates the above-said facts. Furthermore, the injured of this case also sustained fire-arm injury. The informant has disclosed the name of those persons, who were carrying fire-arm in their hands at the time of alleged occurrence and in the list of aforesaid persons, the name of petitioner does not figure and, therefore, it appears that at the time of alleged occurrence, the petitioner was not carrying any fire-arm in his hand.

Patna High Court Cr.Misc. No.1307 of 2015 (2) dt.13-01-2015 2/2 Considering the facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with S.Tr. No. 117(A) of 2014 arising out of Goh P.S. Case No. 129 of 2013 to the satisfaction of Special Judge-Ist, SC/ST, Aurangabad.
