JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-01-2015 Petitioner is languishing in custody since 21.09.2014 in a case registered for the offences punishable under Sections 323, 341, 376/511, 379, 506, 34 of the I.P.C. It is alleged that petitioner entered into the house, attempted to establish forceful physical relationship with the informant and committed theft.
It is submitted by learned counsel for the petitioner that at earlier point of time the mother of the petitioner lodged Motihari Muffasil P.S. Case No. 49 of 2014 making accusation under Sections 436, 34 of the I.P.C. Hence the present case has been lodged when no medical examination of the victim has been done.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail
Patna High Court Cr.Misc. No.2270 of 2015 (2) dt.20-01-2015 2/2 bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Motihari Muffasil P.S. Case No. 317 of 2014.
