Petitioner is in jail custody since 19.6.2014 in a case in which charge sheet has been submitted under section 376 of the Indian Penal Code on the accusation that he established physical relation with the informant on false promise of marriage and when the informant became pregnant, he refused to solemnize his marriage with the informant. Informant was examined by the medical board and she was found between 17 to 19 years.

Moreover, charge sheet has already been submitted and therefore, considering the aforesaid facts and circumstances as well as submissions of the parties, let the

Patna High Court Cr.Misc. No.48086 of 2014 (5) dt.25-06-2015 petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kishanganj in Dighalbank P.S. Case no. 47/2014.
