JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-04-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with POCSO Case No. 13 of 2015 (Ara Muffasil P.S. Case No. 313 of 2015), registered under Section 376 and 511 of the Indian Penal Code and under Section 8 of POCSO Act, 2012.

The accusation is of attempting to commit rape upon the minor daughter of the informant by the petitioner. Learned counsel appearing on behalf of the petitioner submits that, in fact, the petitioner and the informant are co-villagers and due to grudge and enmity he has been falsely implicated in this case. Further submission is that petitioner is aged about 30 years and there are three children as such no can imagine about making attempt to

Patna High Court Cr.Misc. No.9335 of 2016 (2) dt.06-04-2016 2/2 commit rape upon the daughter of the informant. The petitioner is in custody since 27.09.2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. District Judge-1st, Bhojpur in connection with POCSO Case No. 13 of 2015 arising out of Ara Muffasil P.S. Case No. 313 of 2015.
