The petitioner is languishing in custody since 04.07.2014 in a case registered for the offences punishable under Sections 302, 379, 120B of the Indian Penal Code and 27 of the Arms Act.

It is alleged that the informant was sleeping with her husband on the roof when the petitioner along with Harendra and Dhiraj came and on the order of the petitioner coaccused Harendra fired which caused injury on the temporal region and thereafter they dragged the husband of the informant when co-accused Aditya Singh conveyed that the husband of the informant is still alive, thereafter this petitioner after taking country made pistol from Harendra fired on the husband of the

It is submitted by learned senior counsel for the petitioner that there is specific accusation against co-accused Harendra to have caused injury on the temporal region in the FIR and that injury gets reflected from the post-mortem report. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

It is submitted by learned counsel for the informant that there is accusation of firing against this petitioner also, but he has not controverted this fact that only one injury on the temporal region has been found during post-mortem. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (Model) P.S. Case No. 442 of 2014.
