2. Petitioner seeks regular bail in connection with Patahi P.S. Case No. 309 of 2024 dated 02.12.2024 registered for the offences punishable under sections 96, 352, 351(2)/3(5) of the Bharatiya Nyaya Sanhita, sections 3(1)(r) and 3(1)(s) of the SC/ST Act and section 8 of the POCSO Act.

The main submissions advanced by petitioner's counsel are that the petitioner is a 22 year old young person and the facts stated by the informant in the FIR, have not been supported by the victim in her statement recorded under section 183 of BNSS as the victim has accepted her love affair and marital relationship with the petitioner, which completely falsifies
Patna High Court CR. MISC. No.33158 of 2025(3) dt.14-08-2025 2/2 the prosecution's allegations and the medical board has assessed the age of the victim between 17 to 18 years. It is further submitted that the petitioner has been languishing in jail since 27.02.2025, having fair and clean antecedent and against him, the investigation has been completed.
4. Learned counsel appearing for the O.P. No. 2 (informant) submits that as per the information provided to him by the informant, a good relationship has been established between both the parties outside the court and they have settled the present matter.

Considering the aforesaid submissions and mainly taking into account the petitioner's custody period, victim's statement recorded under section 183 of BNSS before the judicial Magistrate, wherein, the victim had accepted her love affair and marital relationship with the petitioner and coupled with completion of investigation against the petitioner, this Court is inclined to release him on bail. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs.20,000/-(Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the court concerned in connection with Patahi P.S.
