2. The petitioner seeks bail in a case registered for the offence punishable under Sections 303(2), 338, 336(3), 318(4) and 3(5) of the B.N.S.
3. The allegation in the First Information Report is that the informant, who is an ASI, in course of vehicle checking apprehended a person, namely, Rohit Kumar who was unable to produce any documents with regard to the motorcycle. Upon enquiry, he disclosed that he had purchased the said motorcycle from a motorcycle garage mechanic namely, Chandan Kumar. Further, the informant went along with apprehended accused to the garage of co-accused Chandan Kumar and upon enquiry, he took the name of the petitioner Bipin Das that the said motorcycle was given to him by the
Patna High Court CR. MISC. No.32278 of 2025(2) dt.19-05-2025 2/3 petitioner. He also disclosed that Bipin Das had stolen the motorcycle from Patna and had given it to him for sale.
4. Learned counsel for the petitioner submits that the name of the petitioner has transpired in this case on the basis of the disclosure statement made by co-accused Chandan Kumar before the police. It has been submitted on behalf of the petitioner that there is no other material collected during the course of investigation to connect the petitioner with the stolen motorcycle. It has been stated that the petitioner was arrested on 09.03.2025 and the recovery of the said motorcycle was made from one Rohit Kumar as would appear from the FIR itself. Further charge-sheet has already been submitted against the petitioner and he has no criminal antecedent.
5. Learned APP for the State has opposed the application for anticipatory bail.
6. In the facts and circumstances of the case, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Khaira P.S. Case No. 413 of 2024.
7. However, the court below shall verify the criminal

No.32278 of 2025(2) dt.19-05-2025 3/3 antecedent of the petitioner and in case it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner.
