Heard learned counsel for the petitioner and the State.
The petitioner is languishing in jail since 12.09.2014 in a case registered for the offences punishable under sections 399, 402 I.P.C and section 25(1-B)a, 26/35 of the Arms Act and 4/5/6 of the N.D.P.S. Act.
It is alleged that from the possession of co-accused Ansar one loaded country made pistol was recovered who disclosed the name of 9 persons including the petitioner who were making preparation to commit dacoit.
It is submitted by the learned counsel for the
Patna High Court Cr.Misc. No.1014 of 2015 (2) dt.12-01-2015 petitioner that nothing has been recovered from his possession of the petitioner and his name has sprung up on the statement of coaccused. Statement to this effect has been made in paragraph 7 of the petition.
Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Sessions Judge, Katihar in connection with Kadwa ( Balia Belon) P.S. Case No. 315 of 2012 G.R. No. 4167 of 2012.
