For the Petitioner/s : Mr. Dhirendra Nath Jha, Advocate For the Opposite Party/s : Mr. Ajay Kumar 2, APP ====================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA PRAKASH ORAL ORDER 08-07-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in S.T. No.873 of 2012 arising out of Agamkuan P.S. case No.99 of 2012 instituted for the offence under Sections 25(1-B)A, 26, 27, 35 of the Arms Act and Sections 353, 307/34 of the Indian Penal Code, pending in the court of 1st Additional Sessions Judge, Patna City, Patna. Perused the show cause of the Station House Officer, Agamkuan, Patna. It appears that the Exhibits had been produced before the 4th Additional Sessions Judge, Patna City earlier in Sessions Trial No.805 of 2012 whereafter it was required in Sessions Trial No.873 of 2012. When it was brought to the notice of the Trial Judge that the Exhibits were available in Sessions
Patna High Court Cr.Misc. No.38934 of 2014 (5) dt.08-07-2015 2/2 Trial No.805 of 2012, he called for the same by order dated 8.1.2015 and hence now there is no problem with regard to conclusion of trial.
Considering the aforesaid development now, the Trial Court is directed to conclude the trial expeditiously without granting unnecessary adjournments to any party.
In view of the stage of the trial, I am not inclined to review the earlier order refusing bail to the petitioner. Prayer for bail is once again rejected.
