The petitioner is accused in connection with S. Tr. No. 71 of 2015/545 of 2013 arising out of Alipur P.S. Case No. 18 of 2011 registered under sections 147, 148, 149, 341, 307, 326, 302 of the I.P.C., 27 of the Arms Act and 17 of the Criminal Law Amendment Act pending in the Court of A.D.J. 9th at Gaya. Admittedly prayer of the petitioner for bail was refused twice on merit vide Cr. Misc. Nos. 28460 of 2013 and 8885 of 2015 on 19.04.2014 and 22.04.2015 respectively taking into consideration the nature of allegation against the petitioner. The report as received from the Court of IXth Addl. Sessions Judge, Gaya vide Letter No. 28 of 26th February, 2016 discloses that the record was running for appearance of rest
Patna High Court Cr.Misc. No.7478 of 2016 (3) dt.09-03-2016 2/2 accused person and for their appearance, process of section 83 Cr. P.C. has been issued. The trial is expected to be concluded with nine months.
Having considered the facts and circumstances of the case, I am not inclined to allow the prayer of the petitioner. Accordingly, the application is rejected. However, trial Court is directed to conclude the trial preferably within a period of 9 months by taking all effective steps.
