The petitioner seeks bail in S. Tr. No. 340 of 2018/ 44 of 2019, arising out of Makhdumpur P.S. Case No. 132/2018, instituted for offences under Section(s) 302, 120(B)/34 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that petitioner is cousin brother of the wife of deceased. There is no allegation of specific overt act against this petitioner. Earlier prayer for bail of petitioner was rejected by a Co-ordinate Bench of this Court vide order dated 10.01.2019 passed in Cr. Misc. No. 74942/2018 with liberty to renew prayer for bail after framing of charge.
Learned counsel for the petitioner has submitted that
Patna High Court CR. MISC. No.32353 of 2019(2) dt.16-07-2019 2/2 charge has already been framed in this case on 28.03.2019. Certified copy of order of the Court below framing charge has been annexed as Annexure-3.
Petitioner is in custody since 28.06.2018.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. Sessions Judge, Jehanabad, in connection with S. Tr. No. 340 of 2018/ 44 of 2019, arising out of Makhdumpur P.S. Case No. 132/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
