=========================================================== CORAM: HONOURABLE MR. JUSTICE AHSANUDDIN AMANULLAH ORAL JUDGMENT Date: 18-05-2016 Heard learned counsel for the petitioner and Mr. Pranav Kumar, learned A.P.P. for the State.

The petitioner seeks bail in S.T. No. 298 of 2013 arising out of Barari P.S. Case No. 19 of 2013 dated 01.02.2013 instituted under Sections 302/316/34 of the Indian Penal Code. This is the second attempt of the petitioner for bail as earlier such prayer was rejected by order dated 12.08.2014 passed in Cr. Misc. No. 13721 of 2014.

In view of the aforesaid, on 20.04.2016, a report was called from the Court below with regard to the status of the case and the likely time by which the trial can be concluded. Pursuant to the same, a report has been sent by the Additional District and Sessions Judge, IV, Katihar dated 9th May, 2015 in which it has been stated that the matter is pending hearing and likely to be concluded within one month.

In view of the aforesaid, the Court is not inclined

Patna High Court Cr.Misc. No.3092 of 2015 dt.18-05-2016 2/2 to consider the prayer for bail of the petitioner as trial is at the last stage of final disposal.

Accordingly, prayer for bail stands rejected. However, the Court below is directed to ensure that the trial is concluded within one month. Registry shall communicate the order to the Court below through Fax also latest by tomorrow.
