JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 29-02-2016 Heard learned counsel for the petitioner and learned A.P.P. representing the State.

The petitioner seeks bail in connection with Samastipur (Mufassil) P.S. Case No. 236 of 2014 registered for the offences punishable under Section 394 of the Indian Penal Code and further Sections 412, 414 and 216(A) of the Indian Penal Code have also been added.

The petitioner is not named in the First Information Report. It is submitted that on the basis of confessional statement of petitioner made in another case, the petitioner has been implicated in this case, nothing has been recovered from possession of the petitioner, he is suffering in custody since

Patna High Court Cr.Misc. No.6643 of 2016 (2) dt.29-02-2016 2/2 25.08.2014 but he has not been put on TIP and without any cogent material, he is suffering in custody whereas, co-accused Birju Sahni, Gaurav Thakur and Lalita Devi have already been allowed bail by another co-ordinate Benches of this Court. The learned A.P.P. submits that the petitioner has got criminal antecedent.

In the facts and circumstances stated above, the petitioner, above named, is also directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Samastipur in connection with Samastipur (Mufassil) P.S. Case No. 236 of 2014 subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
