The petitioner apprehend his arrest in connection with Tekari (Panchanpur O.P.) P.S. Case No. 306 of 2018, registered for the offences punishable under Section 414 and 34 of the Indian Penal Code.
On the disclosure made by accused Chanchal Tati four stolen motorcycles were recovered from his house and one motorcycle was recovered from the house of Ranjan Tati. The said Chanchal Tati has disclosed the name of the petitioner as thief and supplier of the aforesaid motorcycle to him. It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. Petitioner
Patna High Court CR. MISC. No.31767 of 2019(2) dt.13-05-2019 2/2 has no concern with the aforesaid occurrence. He has been falsely implicated in this case. There is nothing on record indicating the complicity of the petitioner barring the confessional statement of the co-accused Chanchal Tati due to animosity. No case of theft of motorcycle has been lodged against the petitioner earlier. No incriminating article has been recovered from the conscious physical possession of the petitioner.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Gaya in connection with Tekari (Panchanpur O.P.) P.S. Case No. 306 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Prakash Chandra Jaiswal, J) T.Kr./- U T
