Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 190, 191(2), 191(3), 109, 303(2), 317(2), 317(4), 315(5), 111, 125, 132, 121(1), 121(2) of the Bharatiya Nyaya Sanhita and Section 27 of Arms Act.

The learned counsel for the petitioner submits that petitioner has antecedent of two cases and the informant alleges that based on secret information of extraction of sand by the sand mafia, the police conducted raid at the bank of Falgu river and apprehended 6 persons on spot with 21 tractors loaded with sand along with one Hero Honda Motorcycle.

Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.37881 of 2025(2) dt.25-06-2025 2/2 petitioner was not arrested from the spot as such nothing was recovered from his conscious possession. It is next submitted that petitioner is not the owner of any of the seized tractors, but since he has antecedents, as such he came to be implicated. It is also submitted that Jitendra Yadav has been granted the privilege of anticipatory bail by a learned Co-ordinate Bench by an order dated 18-6-2025 in Cr. Misc No. 35517 of 2025. 5.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Muffasil P.S. Case No. 947 of 2024, subject to the conditions as laid down under Section 482 (2) of the BNSS.
