The petitioner seeks bail in R.C. Case No. 18A of 2011 (Special Case No. 115A/2011), registered for the offences punishable under Section 420 and other Sections of the Indian Penal Code and under Sections 13(2) read with 13(1)(d) of the P.C. Act, 1988.
The gist of the allegation is that Yogendra Ram the Branch Manager of Central Bank of India disbursed K.C.C. loans to 358 persons and thereby defalcated Rs. 1.79 crores. Learned counsel for the petitioner submits that allegation against the petitioner is that the petitioner was an agent and Rs. 21 Lakhs was credited in current account no. OD-40 standing in the name of Padukalaya. The petitioner is the
Patna High Court Cr.Misc. No.3993 of 2015 (4) dt.31-03-2015 2/2 proprietor of the aforesaid Padukalaya. It is further submitted that Yogendra Ram has already been enlarged on bail. The petitioner is in jail since 11.12.2014.
It appears that the petitioner is not the sanctioning authority. The petitioner may have conspired with Yogendra Ram, the main accused and the then branch manager of Central Bank of India. The petitioner had also remained in jail for about four months.
Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Learned Special Judge, C.B.I., Patna in connection with R.C. Case No. 18A of 2011 (Special Case No. 115A/2011).
