The petitioner seeks bail in Alipur P.S. Case No. 85 of 2018, instituted for the offence under Section(s) 304(B) and 34 of Indian Penal Code.

In the written report it is alleged that niece of the informant was married with petitioner. The informant got information that his niece has consumed insecticide. The informant went to her sasural and learnt that she has been taken to Tekari Hospital by her Bhainsur and Dewar. It is further alleged that both were returning from Tekari Hospital and told the informant that due to shortage of money, they have returned. The niece of the informant told that she had taken poison. The informant and others were trying to take her to Jehanabad for

Patna High Court CR. MISC. No.31542 of 2019(3) dt.27-06-2019 2/2 treatment, but she died.

Counsel for the petitioner submits that from the written report it is apparent that petitioner was not present at the time of occurrence. The victim herself consumed poison. Petitioner is in custody since 9.3.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Gaya, in connection with Alipur P.S.
