JUSTICE PRABHAT KUMAR JHA ORAL ORDER 15-01-2015 Heard Sri Ajay Kumar Thakur, learned counsel for the petitioner. It appears that the case was committed under different Sections of Unlawful Activities (Prevention) Act, 1967. The same is Schedule offence in N. I. Act, 2008. It has already been held by the Division Bench of this Court in Cr.W.J.C. No. 487 of 2014 that any order with regard to the said offence is appealable and the case shall be tried by the Sessions Court. In view of the aforesaid fact, learned counsel for the petitioner seeks permission to withdraw this bail petition with liberty to file appeal. Permission is granted. Bail petition is dismissed as withdrawn.
