In this case, the petitioners and others are involved in unlawful assembly and in order to maintain the law, Mohan Bin, the petitoiner and others actively participated in assaulting the informant as well as his brother who has died at the spot. Against Mohan Bin there is an allegation that he used Sabal and caused injury on the head. Tufani Bin has also used the Sabal. At the same time, Bircha Bin was also assaulted in course of fight. There is a direct allegation against the petitioners Mohan Bin and Ram Pravesh Bin.
Accordingly, the prayer for bail of the petitioner nos.1
Patna High Court Cr.Misc. No.7652 of 2016 (4) dt.19-04-2016 and 3, namely, Mohan Bin and Ram Pravesh Bin is rejected. Both the aforesaid petitioner nos.1 and 3 will be at liberty to renew their prayer for bail after one year of judicial custody.
As the petitioner no.2, namely, Lovani Devi, has already been released on bail vide order dated 24.2.2016, there is no need to pass any order.
