JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 07-05-2019 Heard learned counsel for the petitioner and the State. The petitioner is aggrieved by the action of the respondents in canceling the gun license only on the ground of pendency of the criminal case.
Learned counsel for the petitioner submits that subsequently the petitioner was acquitted vide Annexure-5 in 2004 and thereafter the petitioner has represented the licensing authority for grant of arms licence.
Considering the subsequent development after cancellation of licence, the writ application is disposed of with liberty to the petitioner to represent the District Magistrate, Bhojpur, Ara along with a copy of this order and judgment of
Patna High Court CWJC No.10301 of 2019(2) dt.07-05-2019 2/2 acquittal and on filing of such application the District Magistrate shall pass fresh order on the issue of restoration of arms licence of the petitioner, as the only reason for cancellation of arms license is no more existence after the order of acquittal. Necessary decision in this regard must be taken by the District Magistrate, Bhojpur within a period of three months after the general election.
