The petitioner has preferred this application for grant of regular bail in a case registered under sections 414 and 34 of the Indian Penal Code and sections 20 and 22 of the NDPS Act. As per the prosecution case, 400 grams of opium was recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case because of his antecedents. No incriminating article has been recovered from his possession. He is in custody since 13.11.2020 and investigation in the case has concluded. The petitioner has no criminal antecedent under the NDPS Act. Heard learned APP for the State.
Having heard learned counsel for the parties and
Patna High Court CR. MISC. No.44364 of 2021(4) dt.08-03-2022 2/2 taking into consideration the facts of the case together with the petitioner having remained in custody for more than 1 year 3 months and not having any criminal antecedent under the NDPS Act, the Court directs the petitioner to be enlarged on bail in connection with Saraiya P.S. Case no. 732 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, NDPS Act, Muzaffarpur.
