====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-09-2023 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379/34 of the Indian Penal Code.

3. As per prosecution case, on 15.05.2022, informant along with others had gone to village Kakkardom to attend marriage function of one Manoj Kumar Yadav and during Jaimala function, altercation took place in which all the F.I.R. named accused persons including these petitioners and 10-20

Patna High Court CR. MISC. No.41796 of 2023(3) dt.25-09-2023 2/2 others assaulted the son of the informant with various weapons and snatched his mobile phone, wrist watch, golden chain and some cash.

4. It is submitted on behalf of the petitioners that a free fight took place between the parties because some barati molested a girl from the bride side in which son of the informant got injured. Allegation of assault is general and omnibus. No specific overt is alleged against these petitioners and they have got clean antecedent.

5. Considering the nature of allegation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Jhanjharpur in connection with Laukahi P. S. Case No. 121 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
