The petitioner seeks bail in Gopalpur P.S. Case No. 89 of 2019 corresponding to Special Case No. 3004 of 2019, instituted for the offence under Section(s) 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per written report total 48 litres of foreign liquor has been seized by the Police from two different places after making raid as mentioned in detail in the written report. It is mentioned in the written report that petitioner was caught hold with two pouches of 200 ml. country made Mahua liquor. Petitioner is in custody since 19.3.2019.

Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.31742 of 2019(2) dt.13-05-2019 2/2 of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with Gopalpur P.S. Case No. 89 of 2019 corresponding to Special Case No. 3004 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner.

It is mentioned in paragraph-3 of the bail petition that one Excise case of Fatuha P.S. Case No. 646 of 2018 corresponding to Special Case No. 10231 of 2019, is pending against the petitioner. Petitioner will file affidavit at the time of furnishing bail bonds that he will not indulge in such type of activity in future, failing which, the bail bonds of the petitioner in the instant case will liable to be cancelled.
