====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 15-12-2021 Heard learned senior counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with Ghuthani P. S. Case No.33 of 2021, instituted for the offences under Sections 8/20(B)(ii)(A)/ 21(B) of the N.D.P.S. Act.

The learned senior counsel for the petitioner submits that the petitioner is in custody since 12.02.2021, she is a person with clean antecedent, charge-sheet has been submitted against her and she is a young girl aged about 20 years.

Patna High Court CR. MISC. No.44305 of 2021(2) dt.15-12-2021 2/3 submits that the informant in the F.I.R. alleges that Rs.9,77,000/- was recovered from scooty of the petitioner, who disclosed that the money belongs to Sunil Singh alias Sudhir Singh uncle of Rishikesh with whom the petitioner was talking and also disclosed that the money is sale proceeds of narcotics. Accordingly, it is alleged that the house of Sunil Singh alias Sudhir Singh was searched and total 1.654 kg. of ganja was recovered.

The learned senior counsel submits that from allegation as alleged in the F.I.R., it would manifest that as far as allegation of recovery of narcotic is concerned, that is not alleged against this petitioner. It is further submitted that she is a young girl aged about 20 years and she came to be implicated merely because she was talking with Rishikesh, who is nephew of Sunil Singh alias Sudhir Singh. The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody since 12.02.2021, she is a person with clean antecedent, charge-sheet has been submitted against her and she is a young girl aged about 20 years, the petitioner,

Patna High Court CR. MISC. No.44305 of 2021(2) dt.15-12-2021 3/3 above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Siwan in connection with Guthani P. S. Case No.33 of 2021. The application stands allowed.
