Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the complainant and is being prosecuted for the offences punishable under Sections 498 A, 384, 380, 307, 494/34, 120 B of the Indian Penal Code in a complaint case.
It would appear from perusal of the record that initially the petitioner was granted privilege of provisional bail for two months vide order dated 20.05.2014 but he surrendered before the court below on 05.08.2015 i.e. after more than one year of
Patna High Court Cr.Misc. No.14195 of 2014 (7) dt.07-08-2015 2/2 granting provisional bail. However, petitioner seeks bail on the ground that matter has already been compromised between the parties which is evident from perusal of Annexure-4 to this petition.
In the aforesaid circumstance, learned court below is directed to verify the genuineness of compromise petition filed on behalf of the parties before the court below on 21.05.2012 and if the compromise petition is found genuine, in that event, the learned court below shall release the petitioner on bail in connection with Complaint Case No. 3569 C of 2009 fixing the amount of bail bonds on its own level.
