The petitioners seek bail in anticipation of their arrest in connection with Piri Bazar P.S. Case No. 61 of 2020 instituted for the offence under Sections 341, 323, 324, 307, 448, 504, 506/34 of the Indian Penal Code. The informant is the full brother of the petitioners and the allegation against them is of having assaulted another brother of the informant. Learned counsel for the petitioners has submitted that there is a dispute between the brothers with respect to maintaining their mother and precisely for this reason, even the mother of the informant has been made accused. This appears to be a family dispute and even if some scuffle had taken place, it has been argued, there cannot be any intention to inflict any grievous injury on any one of the victims.
Regard being had to the nature of accusation against the petitioners and their relationship and also taking into account that the petitioner no. 2 is a student, the petitioners, above named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Lakhisarai, in connection with Piri Bazar P.S. Case No. 61 of 2020, subject
